日前,重庆田先生请朋友吃火锅时被要求了50元的“最低消费”。他愤而投诉,由此引出了业内关于应该如何正常收费的讨论。

设最低消费显失公平

    提起“最低消费”屡禁不止的现象,西南政法大学教授韦峰坦言,“最低消费”是违反法律、常理和道德的霸王条款,是对消费者不公平的一种交易行为。

    重庆市消费者权益保护委员会投诉部主任喻军也称,该火锅店的最低消费标准要求,是显失公平的交易行为,违反了《消费者权益保护法》等相关法律、法规。

火锅业约20%设最低消费

    不过据走访了解,目前,重庆市火锅业中,有约20%的经营者设有最低消费门槛,多以50元为收费标准。

    骑龙火锅有关人士坦言,因为保证品质和成本的原因,他们开业至今一直有最低消费的规定,至今其所有连锁、加盟店,均按不同地区设置了每锅50元、60元、80元不等的最低消费标准。此外,他们还依据不同区域,在部分店面设置了15元和20元的锅底费。但他特别强调,店里“至今是有规定没执行,因为来店的客人消费都能超过规定的底线”。

    家福、骑龙等火锅企业接受采访时表示,与前一两年相比,餐饮业门面租金已翻了好几倍,人工从原来的7%左右涨到现在的20~30%,原辅材料价格的增速则达5~6%。此外,茶水、米饭、银耳汤、空调甚至是眼镜布,在火锅馆都属赠送品。纯粹依托菜品收费,已让火锅业很难盈利。

正规收费也能取之有道

    一从事火锅业多年的专业人士称,设立最低消费,对经营者来说也确实是不得已而为之。不过,该人士坦言,以最低消费将顾客拒之门外,则纯粹是名不正言不顺。“客人难以接受,经营者信誉也受损。”

    他认为,最低消费本来是粗放经营时代的产物,现在讲究经营的正规化,最好、最正确的方法,应该是“该收费的就大方、坦然地收,不该收的则应懂得舍弃”。
